BOOK COVER DESIGN

CONFIDENTIALITY
1. All client information and materials are considered confidential and only for use by the Designer to provide a quote or complete a project. Client information and project materials will not be given out or shared with any third party, unless otherwise requested by the client.
 
PAYMENT
2. Client agrees to pay an initial deposit of half the total cost before work will begin on the project. The balance is due upon approval of design. Finished files will not be released to the client or other parties until final payment has been received. The final payment is also final approval of the project. Payments are made through Paypal.
 
SERVICES
3. Work includes only the final, deliverable art, and not any preliminary work or sketches. A design concept, indicative of the final work will be produced by Designer for review and approval prior to the creation of the final work.
 
OWNERSHIP RIGHTS
4. Upon receipt of full payment, Designer grants Client exclusive license to use the final cover design artwork (PDF, JPEG or other publishing-ready format) for his/her book cover and associated promotional materials.
5. Images, fonts, and elements used to design the cover are licensed from third-party providers and may not be distributed in any manner other than in the book cover design. Client agrees to abide by the terms of any license agreement for any image or font purchased by Designer through a third-party provider.
6. Designer retains the right to use the client’s final book cover design, name, and book title in Designer’s portfolio and to market and promote my services. Designer retains copyright of all draft/mock-up materials.
7. If the client supplies Designer with materials subject to intellectual property rights by a third-party, the client will secure the appropriate rights to use the materials before directing Designer to incorporate them into the project. Should any intellectual property dispute arise involving materials the client provides, the client assumes full legal and financial responsibility.
8. Client understands that he/she has no right to alter the final cover design except to change size for printing or digital display. If the client desires any alterations, he/she will consult Designer. Client understands that additional payments may be required to make these alterations.
 
CLIENT RESPONSIBILITIES
9. Client is responsible for proofing the designs provided by the Designer, including spelling and grammar. It is strongly suggested that the client request a proof from the printer before publishing or ordering any copies of the book. At no time will Designer be held financially or legally responsible for any problems, costs, fees, or expenses incurred by the client as a result of using the book cover design.
 
CANCELLATION POLICY
10. Client or Designer may decide to terminate this agreement at any time by providing written notice to the other party. If either client or Designer cancels a project before work has started, neither the client nor Designer is under further obligation to the other, and this contract will be considered cancelled. If the design process has already begun, the deposit becomes nonrefundable and the client is responsible for the cost of any purchased image(s) or fonts.
11. If Client has not provided feedback or communication on a project for 30 days, the project will be considered abandoned and the job will be cancelled. The client will have no rights to any mockups and agrees to destroy them.
 
LIABILITY
12. Designer is not liable to incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including loss of revenues or profits, loss of business or reputation, or loss of data, in any way related to our services. Designer is not responsible for any claim, loss, or injury based on errors or any other inaccuracies appearing on our site or in our clients’ written documents, including without limitation as a result of any breach of the terms and conditions of this agreement.
 
UNDERSTAND OF ALL PARTIES
13. This Agreement is the entire agreement of all parties.
14. This Agreement can only be changed by mutual written consent of both parties.
